Pakistan court erects Walls in Lever Brothers' path for selling Ice Cream

Islamabad, Sept 25: Pakistan's Supreme Court has stopped Lever Brothers from manufacturing and marketing its product Walls ice cream under the product name of `Ice Cream.'

On a petition filed by another ice cream manufacturer, Yummy, the supreme court suspended the orders of the Lahore High Court that had allowed Lever Brothers to sell their product Walls under the product name of `Ice Cream.'The controversy arose when Lever Brothers, under the brand name of Walls, introduced its products in the local market, seriously eroding Yummy's market share. Yummy Milk Products challenged Lever Brothers' products, saying they could not be sold under the brand name of ice cream because they did not contain milk or milk fats.

Yummy approached the Lahore High Court, contending that under Pure Food Rules 1965, a product lacking fats and milk as ingredients could not be called as ice cream. The court upheld Yummy's contention and restrained Lever Brothers from selling its product under the brand name Walls IceCream.Lever Brothers filed an appeal before the division bench of the court which amended the orders of the single bench and allowed both parties to use vegetable oil instead of milk and butter.

Yummy challenged the decision before the Supreme Court, which suspended the orders of the division bench of the Lahore High court and restored the orders of the single bench. Walls media manager and spokesperson Shabana Khalid told IANS that the company will file a review petition within a week. She claimed that hundreds of ice cream manufacturers throughout the world were using vegetable oil.

Yummy has been campaigning against the use of vegetable oil since Lever Brothers introduced Walls eight years ago. "Give your children pure milk and butter...Don't risk your life by taking vegetable oil for ice cream," were among several advertisements the company ran in newspapers and on television.
