TheStreet.com's Cramer files counterclaim against Fox

New York,June 7: The co-founder of TheStreet.com, hedge fund manager James Cramer, said on Tuesday that he has filed a counterclaim against Fox News in response to the news channel's lawsuit filed after the financial Web site cancelled its television programme in May.

In his counterclaim, Cramer alleges breach of contract and seeks an injunction to keep the 24-hour news channel from interfering with his appearance on other TV networks.

Cramer's filing in New York Supreme Court added another chapter to the saga that began when Fox News, operated by News Corp. Ltd.'s Fox Entertainment Group, criticised Cramer for plugging the stock of TheStreet.com on an April 15 programme.

In response, TheStreet.com cancelled the show, also called TheStreet.com, saying that Fox had breached its contract by changing compliance policies without notifying the company and by publicly disparaging it. After the cancellation of the show, Fox filed lawsuits against Cramer and TheStreet.com in May alleging that they both had breached their contracts.Fox News sought damages associated with the cancellation and requested a court injunction to bar Cramer from appearing on any other TV network until his contract with Fox expired.

Cramer said in a statement on Tuesday that Fox News invented new policies that it applied only to him, making it "impossible" for him to appear on `TheStreet.com' programme. He pointed to a Feb. 10 "Your World With Neil Cavuto" show in which media tycoon and News Corp. owner Rupert Murdoch said News Corp. stock was "very, very cheap," compared to other stocks.

"Free expression with full disclosure is a proper policy,and I am pleased to see that Fox News has seen the light when it shines on the largest shareholder of its parent corporation. It's too bad Fox News applied a different standard to me," Cramer said in his statement.

In his counterclaim, Cramer also said he was now free to appear on other TV networks because TheStreet.com show had been cancelled and his contract with Fox News said the agreement would end if Fox News discontinued the programme. "There is no merit to the counterclaims made by Mr Cramer.... He cancelled the show and now claims he does'nt have to perform because the show is cancelled. Jim's argument is irrational," a Fox News spokesman said.Cramer said he was not in breach of contract, which called for him to make at least 40 appearances on the programme within a 12-month period. Cramer alleged that Fox had miscounted the number of weeks remaining in the first year of the contract.
