New Delhi, July 10: The Associated Chambers of Commerce and Industry (Assocham) has suggested establishment of an irrevocable deadline for privatisation of all state electricity boards (SEBs) in consonance with provisions of the Electricity Bill, 2000.The chamber in a statement has said that it would be unwise to leave the pace of privatisation to the states as there is every reason to suspect that they may invent innovative reasons to delay privatisation or come up with riders to the word "sustainable" as allowed in para 7(C) of the draft Bill and thus defeat the very object of the Bill.
Considering the provisions of Section 119 and the fact that the telegraph authority has been empowered under sub-section II to issue instructions to the operator for protection of telegraphic, telephonic lines, an inconsistency sems to appear in sub-section 3.
According to sub-Section 3, if the operator defaults in complying with the requirements of this sectio, he shall make full compensation for all loss and any dispute with regard to the amount of the compensation would be determined by the arbitration . Assocham said in a statement here that instead of the telegraph authority, it should be the TRAI on telecom disputes settlement and appellate tribunal that should be issuing directions contemplated under section 119(2).
