New Delhi, Jan 22: After weeks of speculations on whether the cellular operators will file an appeal against the Telecom Regulatory Authority of India (Trai) permitting WLL mobility on Monday, the Cellular Operators Association of India (COAI) filed a case finally with the Telecom Disputes Settlement and Appellate Tribunal (Tdsat).Justice Sen, the sole judge at the Tribunal, confirmed that the Coai has filed papers with the Tdsat. However, he declined to make comments on the details of the representation. When contacted, cellular operators refused to comment. Despite repeated attempts, the official Coai spokesperson was not available for comment. However, chairman of Coai Vinay Rai confirmed from London, that the association was to file its petition on Monday.
Ever since the limited mobility issue came up in September 2000, the cellular operators have been considering (threatening) to take legal recourse. The cellular operators are reported to have taken legal advice from a battery of top corporate lawyers on their legal stance. However, the decision to challenge the recommendations was formalised at a Coai meeting on January 10, 2001, wherein all the top echelon of the cellular world got together to debate the course of action. The Coai director general TV Ramachandran had earlier said that the Trai's recommendations, which would allow backdoor entry for FSPs into mobility, shows its pre-determined stance and had made the fourth operator guidelines completely redundant within days of their being issued.
