Revoke anti-dumping measures, India tells EU

Berlin, March 13 : India on Tuesday demanded that the European Union (EU) should immediately revoke the anti-dumping measures and refund the duties collected for the past three years on imports of bed-linen from India.New Delhi moved quickly to make this demand at a meeting of the dispute settlement body (DSB) of the Geneva-based World Trade Organisation (WTO) after it adopted the reports of the appellate body and a panel that gave a verdict in favour of New Delhi by declaring as illegal imposition of the duties.

``India calls upon the EU to honour its obligations and to act without further hesitation or delay,'' Indian ambassador to WTO S Narayanan said while asking the 15-nation bloc to draw ``appropriate and only conclusions'' of the report.

The Appellate body recently toughened the ruling against the EU after upholding the original decision by a three-member panel and said the panel had gone too easy on the EU.

The ruling of the panel, which also held the anti-dumping duties violated free trade rules, was a major trade victory for Indian textile exporters. The appellate body had condemned the method used to calculate dumping duties by EU, which appeared to grudgingly accept the verdict.

India said WTO's ruling confirmed that the EU's action were ``critically flawed'' and inconsistent with the anti-dumping agreement in two areas - the determination of injury and the calculation of dumping duties.

The DSB meeting was told illegal levying of anti-dumping duties on imports of bed-linen from India had ``adversely affected'' its access to European market.

The EU delegation told the DSB meeting that it was surprised and concerned about the final report as it was ``difficult to understand'' and made a ``narrow and too literal reading'' of the provisions of the anti-dumping agreement.

The real implications of the ruling from a legal and factual point of view were yet to be seen and the EU was at present studying them in detail, the delegation said.

It, however, added that these criticisms will not detract it from ``promptly'' complying with the WTO ruling.
