Bombay High Court issuesinjunction against RWITC

MUMBAI, May 14: The Bombay High Court issued an injunction against the Royal Western India Turf Club (RWITC) ordering the Club not to make any major policy decision, and, not to incur any major expenditure without prior intimation to the Government.

The State Government had filed a notice of motion (No 1087/97 in appeal No 732/95) against RWITC. The court was urged to order the Club to follow the Department of Company Affairs (DCA) directive of issuing voting rights to all members.

The matter had come up for hearing before Justice YS Jahagirdar, the Vacation Judge of Bombay High Court after a directive issued by the bench of Chief Justice Mr MB Shah and Justice Rebello when it appeared before them on May 7.

Considering the urgency in view of the DCA directive which said that if the Club does not meet the Company Law requirements all actions of the present directors (commitee members) would be held illegal and void, the honourable judges placed the matter before the Vacation Judge yesterday and the above orders were passed.

The main plea -- voting rights to all categories of members and injunction on renewing racing license to the Club -- will be decided by the regular bench of the High Court on June 23.
