"The Governor never discussed Tata funding with me"

The mood in Assam Bhawan is upbeat. Having successfully averted a near political disaster, Chief Minister Prafulla Kumar Mahanta is a relieved, if not relaxed, man today. "My stand is vindicated," is how he reacts when asked about the Governor's refusal to grant sanction for his prosecution in the multi-crore-rupee LoC scam. However, his worries aren't over. The Congress has accused the Governor of being biased and asked the President to intervene. Some in the party have said the case should now go to the Supreme Court. Then there are rumblings within his AGP.

In New Delhi, to discuss poll security measures with the Election Commission, Mahanta spoke to SHIVANI on the LoC controversy, the Tata-ULFA case and the elections. Excerpts:

  • The Governor's refusal to give sanction to the CBI must have come as a breather to you.

    The Governor has taken a judicious view. It's obviously the conspiracy of the Congress and former CBI director R.C. Sharma. Sharma was influenced by MatangSingh, Sitaram Kesri and prime accused Rajen Bora in levelling these wild allegations against me. I have not taken a single penny. Sharma persuaded Bora to give a statement against me by offering to make him an approver. In fact, I am going to file a defamation case against all these people.

  • Isn't the Governor playing the part of the prosecutor by calling for more evidence and more documents?

    He can certainly ask for more evidence and documents. There are several judgments on it. He must apply his mind before granting sanction. He has the right to call for the documents.

  • The Congress has claimed that the Governor is protecting you and that a deal has been struck between the two of you.

    These are wild allegations. I have not met a single CBI officer till today. I have not paid any money to anybody.

  • But weren't you interrogated by the CBI? They even produced a statement by you dated July 16, 1997.

    I have never been interrogated by the CBI. I was already in Delhi andfew of these officers came to meet me. It was a courtesy call.

  • So the statement was fabricated by the CBI?

    I don't want to blame the CBI. It was the handiwork of only one person, R C Sharma.

  • But he wasn't the director then.

    (Keeps quiet)

  • Changing the subject, it's being said you too are playing dynastic politics by projecting and promoting your wife.

    She is an ordinary member of the party and by being an MP here, how can she influence the party in Assam? She is not an office-bearer.

  • All the more reason not to give her a ticket. Did you persuade her?

    She was involved with the AASU. I did not persuade her. The decision was taken by the district committee and the president and the MLAs. There is no question of her being groomed and projected as my successor. She would be an MP and the leader of the AGP would be chosen by the elected MLAs.

  • There's some talk of the AGP aligning with the BJP in the event of a hungParliament.

    This is not the appropriate time. This question does not arise now.

  • Hypothetically...are you keeping your options open?

    (Laughs) United Front will form the government.

  • What will be the AGP's role in the event of a Congress-led coalition or if the Congress is a part of the government?

    It will be difficult for the AGP.

  • Who do you see as the Prime Minister if the United Front manages to form the government again? Gujral?

    That will be for the elected MPs to decide.

  • Will Sonia's participation make any difference for the Congress?

    Not in Assam. Local issues are going to dominate, not Sonia Gandhi. This is the weakness of the Congress that to save their party from extinction, they have to bank on her.

  • Coming to the problems of the North-East. The biggest problem is that of insurgency and the biggest case so far has been that of Tata allegedly funding the militants. Yet there seems to be no progress in the case. Isn't thestate government going soft on the probe?

    No, the government is not going soft. The inquiry is on.

  • But the investigations don't seem to be reaching anywhere. Your entire argument in the Supreme Court had been that the arrest of the officials is necessary as custodial interrogation is a must for the investigation. Yet even after the apex court cleared the decks for their arrest, they have not been arrested so far.

    Their interrogation has been done.

  • When was the last interrogation?

    I forget.

  • Approximately...?

    After the Supreme Court order.

  • But why no arrests?

    No, it should be foolproof. You may arrest anybody any time but to establish the case you must collect more evidence for which the interrogation and inquiry are going on.

  • So why emphasise on custodial interrogation then?

    The Supreme Court did not allow it.

  • That isn't exactly the case...

    (Keeps quiet)

  • Some of your critics say that theGovernor brokered a truce between you and the Tatas.

    This is a baseless allegation. It's not correct. The Governor has never discussed the Tata funding case with me. Tapes is a different thing. Anybody may approach anybody. Ratan Tata met me here in Delhi where he expressed his ignorance about the incident and said that action will be taken against anybody who was involved.

  • But isn't funding of militant groups a reflection on the inability of the State Government to maintain law and order?

    All this funding began during the Congress rule. The records prove it. We are the ones who highlighted it and tried to stop it.

  • Why the delay in the extradition of ULFA leader Anoop Chetia (from Bangladesh)?

    There's a lacuna in the extradition treaty. We have asked the Central government to expedite it. I have personally written to the Prime Minister. It's difficult to say when he will be extradited.

  • What brings you to Delhi?

    I came here to discuss with the CEC thepossibility of holding elections in Assam in two phases because of inadequate security forces. We want 609 companies as there are about 5,500 sensitive polling booths. But the Centre has expressed its inability to provide 609 companies and then we suggested holding the elections in two phases.
