Chetia case referred to Bangladesh SC

PRESS TRUST OF INDIA  
DHAKA, February 27: A petition seeking stay on Bangladesh high court's order rejecting an application challenging a reported move by the government to hand over arrested United Liberation Front of Assam leader Anup Chetia to India was today referred to a full bench of the supreme court's appellate division for hearing on March four.

Justice Abdur Rauf of threfusing to entertain the application filed by the Bangladesh Human Rights Commission (BHRC).

The full bench will be headed by chief justice ATM Afzal.

The high court had earlier rejected a writ petition on February 16, saying it was premature and held the government can take a decision on deportation treaty with India according to section four of Bangladesh Extradition Act, 1974, and section 2(f) of the Special Powers Act.

In another case, the chief metropolitan magistrate of Dhaka had asked the city central jail authorities to ensure proper medication for Chetia and ordered them to allow a meeting between the detainee and his lawyers.

The orderwas passed on February 12 on a petition moved by the Bangladesh Society for Enforcement of Human Rights.

ULFA general secretary Chetia, wanted in India in connection with several cases, was arrested here on December 21 along with his two associates under Special Powers Act on charges of unlawful stay in Bangladesh, carrying forged Bangladeshi passports and illegally possessing foreign currency.
