SP wants Mendonca to depose

MUMBAI, March 13: The Samajwadi Party on Thursday filed an application before principal sessions judge A S Aguiar praying that the counsel for Mumbai police examine police inspector Vasant Dhoble and Police Commissioner in connection with the death of Javed Fawda in an encounter.

SP counsel Majeed Memon and Abbas Kazmi submitted to the commission of enquiry into encounter deaths that both these are witnesses to facts under inquiry.

Earlier, police counsel Shrikant Bhat had sought direction by the sessions judge to examine the petitioner in Fawda's case, SP (Mumbai) president Abu Asim Azmi.

While the SP petition sought an inquiry into Fawda's death, similar petitions have been filed by Committee for Protection of Democratic Rights and People's Union for Civil Liberties seeking a probe into the killings of Sada Pawle and Vijay Tandel in police encounters. The petitioners alleged that the encounters were stage-managed.

Admitting the petitions, the HC had on December 10, 1997 ordered an inquiry by asessions judge. The counsel to the petitioners cited the HC's observations: ``To enable the learned sessions judge and to appreciate the facts of the case and also to enable him to identify the witnesses to be summoned, copies of the relevant writ petitions and affidavits along with the relevant documents shall be forwarded to him. The learned sessions judge shall examine the deponents of such affidavits as well as the concerned officers.'' Dhoble, responsible for gunning down Fawda on August 28, 1997 is the third respondent in the petition, while Mendonca is the second. The judge is likely to pass an order next week in connection with the above application along with the Bhat plea.
