KOCHI, MAR 13: The High Court in the state has ruled that Kerala State Electricity Board's (KSEB) decision to terminate the implementation agreement with three small hydel projects of Ideal Projects and Services Private Ltd was `illegal and arbitrary'. On a petition by Ideal Projects and Services Ltd, Justice S Sankarasubban ruled that KSEB's termination decision was illegal since the petitioner had already invested on the basis of MoU and implementation agreement.Termination of MoU with respect to West Kallar project-1 was not correct, the court said while upholding the cancellation of eight other projects of the petitioner.
KSEB has been asked to enter into PPA with the petitioner, who would be allowed to execute the implementation agreement with respect to West Kallar scheme with the Ministry of Non-Conventional Energy Sources.
