HC orders Coast Guard official to be released

MUMBAI, April 7: Justice J F Rebello of the Bombay High Court today ordered the Commanding Officer of a Coast Guard vessel, to set free an assistant commandant, Prem Kumar, who was illegally detained on board a ship since March 23.

Kumar's wife Bharati had filed a writ petition against the Coast Guard alleging illegal detention of her husband. The judge ruled that Kumar should not have been detained after the completion of his duty hours. Following LS Asai's orders, the CO of the Coast Guard vessel CGS Amrit Kaur, Kumar was detained after duty hours on March 23. The CO had on Monday told the court that Kumar was on the vessel beyond his duty hours voluntarily. However, the judge directed that Kumar should be produced in court.

Kumar said the CO forced him to stay aboard the ship. Asai filed an affidavit on Tuesday saying Kumar was required to remain on board for counselling and training. The judge said the CO should relieve Kumar as soon as he completed his normal duty hours and set aside Asai's order ofdetention. Advocate Dharmadhikari, along with S C Naidu and Manish Desai, appeared on behalf of the assistant commandant and his wife, while the CO was represented by Vijay Kantharia.
