Court caps school fee hike at 40 %

NEW DELHI, May 4: The Delhi High Court today restrained public schools from charging anything more than the 40 per cent already enhanced fee until further orders. Justices Y.K. Sabharwal and C.K. Mahajan, however, maintained that the already paid hiked fee may not be refunded. The judges also cautioned the schools that ``any further violation of the December 11, 1997, order and enhancement beyond permission would be seriously viewed and may entail contempt proceedings.''

Disposing of several applications filed by the Delhi Abibhavak Mahasangh (DAM) and different schools, the court observed, ``In the facts and circumstances of the case we are not initiating contempt proceedings against erring schools but reiterate the provisions of the order dated December 11, 1997.''

As sought on behalf of some schools that the December 11 order was ambiguous, the bench observed: ``We do not find any ambiguity in the order.''The judges observed that an attempt was made to plead that financial constraints necessitated the enhancement of the fee. ``There can be no justification to charge an enhanced fee without the permission of this court,'' they said.
