CHANDIGARH, May 17: UT Consumer Disputes Redressal Forum II has directed Institute of Homoeopathic Medical Education and Research, Sector 20, here, to pay Rs 10,000 to a student for causing him a loss of one academic year.In addition, the Forum has also directed the institute to refund the entire fee taken from the student at the rate of 15 per cent per annum. The interest is to be paid from the date of deposit till payment. President of the Forum R.P. Bajaj and members H.S. Walia and Kamlesh Gupta have directed that costs of Rs 1,100 should also be paid to the student.
The order was issued following the complaint filed by S.K. Jerath, a resident of Sector 44 here, on behalf of his son Rajiv. In the complaint, Jerath pointed out that in 1993, his son took admission to the degree course advertised by the institute. He paid Rs 26,650 for the admission.
The complainant was assured that the institute was recognised by the Central Council of Homoeopathy to grant BHMS degree. During the session, he learnt that there was no provision in the institute for practical classes and library facilities.
Jerath made inquiries from the Central Council and learnt that the institute had not been given any recognition. In this light, he withdrew his son from the institute in January 1994. Thereafter, he knocked the doors of the court for fee refund, compensation for the loss of one year and mental and physical harassment.
In its reply submitted in the Forum, the institute denied that it had given any assurance that it was recognised for imparting a degree course. The authorities added that the institute had regular staff and infrastructure.The Forum, however, studied the advertisement issued by the institute, which urged students to take admission in the homoeopathic degree college and hospital.
The Forum observed that the prospectus issued by the institute was highly misleading. "The institute was not authorised to run a degree course and still it was named as post-graduate centre," highlighted the order.
The order added that for the year 1993-94, the institute "did not have that particular standard, quality, grade, authority and the permission to run a degree course". The Forum maintained that the complainant's son "had to give up the studies in the institute not because of his own free will but because of the false representations and assurances held out" by the institute.
