MUMBAI, May 22: Additional Sessions Judge R B Malik acquitted two persons who were allegedly involved in the assault case of Shiv Sena activist Dagdu Sakpal in 1985 due to lack of evidence recently.While the main accused Vijay Bogde was already dead, two others Anil Dhakne and Nishikant Passi were charged and tried by the court. On March 7, 1983 Sakpal was attacked by Bogde with a knife and sustained injuries in the head, back and legs outside his residence at Ganesh Nagar at Lalbaug. The prosecution case is that their attack was due to previous enmity between the two. Last week, the judge issued a bailable warrant against Sakpal after he abstained from the court.
The grounds which led to the acquittal of the duo was that during the recording of evidence both Sakpal and his wife were declared hostile to the police case and also that the main accused was no more and also the another eyewitness was not traceable.
Special public prosector G A Pannas appeared for the state.
