Rajasthan Govt pays compensation for custodial violence

NEW DELHI, May 29: The Rajasthan government has sanctioned ex-gratia compensation to three victims of custodial violence and initiated disciplinary proceedings against three police officials, according to the recommendations of the National Human Rights Commission.

NHRC sources said that the State Government sanctioned payment of Rs 15,000 to Baba Khan and Rs 20,000 and Rs 5,000 to his brothers-in-law Mirza Irani and Yusuf Irani.

The State Government has initiated disciplinary proceedings against Ajay Bhargava, in-charge of Dadabari police station where the incident occurred, and other police officers for submitting a false report to the commission.

The commission's recommendation came after a complaint from the Human Relief Society in Patanpol, Kota that Bhargava, along with six policemen, came to Baba Khan's house on the night of July 19, 1995, abused and manhandled him and his wife, and took him forcibly to the police station where he was detained and tortured in police custody.

The sources saidthat Baba Khan's brothers-in-law were also forcibly taken away and physically tortured by the police. Mirza Irani was injured and had to be hospitalised, the complaint stated.

The commission called for a report from the DGP in the crime branch of the crime investigation department. The report admitted that Baba Khan and Mirza Irani were taken to the Dadabari police station, suspecting them to be involved in a dacoity in a local branch of the Punjab National Bank on the night of July 17, 1995.

After interrogation by the additional sub inspector, Baba Khan was allowed to go back on the same day while Mirza Irani was arrested by Bhargava, the report said adding that the allegations made by Baba Khan about his illegal detention were false.

However, the commission not convinced with the report directed its investigation wing to have the matter investigated independently.

The commission's investigation revealed that Baba Khan was whisked away by Bhargava on July 19, detained and tortured till July 25,1995.
