The civic body, Municipal Commissioner Rajiv Agarwal and Mayor Vatsala Andekar have been made party to the case. Shiv Motaria, civil judge at the PMC court, has issued notices to the Agarwal and Andekar directing them to submit their say before the case stands for hearing on June 26.

In its petition, the association has argued that the general body resolution was unlawful as there was no provision in the Bombay Provincial Municipal Corporation (BPMC) Act ruling that the officers should attend the meetings.

The association argued that according to the BPMC Act, the commissioner can only summon an officer at the meeting to seek explanation over a civic issue pertaining to the department headed by the officer concerned. The commissioner can not ask all the officers to be present for the meeting, the association has stated urging the court to restrain the civic chief from acting upon the general body resolution.

The administration and the mayor have decided to defend their stand and would file their say shortly, sources said.

Meanwhile, the general body meeting today put in abeyance an administrative proposal seeking its approval to the promotions given to some 83 civic employees, despite they did not possess the required educational qualification for the post.

The elected representatives criticised the administration for promoting the ``favoured'' civic employees by sidelining those who were educationally qualified. Agarwal assured the general body that he would probe into the matter and would table a report within a month.
