PUNE, JULY 2: The Pune District Consumers' Disputes Redressal Forum has ordered Shree Narayan Developers Private Ltd to pay Rs 12,000 to Eleana Igorevna Mishra, who had booked a plot of land four years back, but was yet to receive it. The builders have been asked to further pay 18 per cent interest on the said amount from the date of filing the complaint.Shree Narayan Developers have also been told to pay the complainant, Mishra, Rs 1,000 as cost of the proceedings and Rs 1,000 as compensation for mental harassment.
In her complaint, Mishra said she had booked a plot of land in November 1989, by going through an advertisement and brochure. The status of `NA' land was mentioned there at a cost of Rs 0.90 per sq feet. Facility of payment by installments was offered at a space of four months interval.
First installment was paid on November 9, 1989.
Second installment was due in March/April 1990, but Mishra received a letter in August 1990 that because of a fire breaking out in the developer's office,the agreement for sale and the second installment was deferred. Soon thereafter, Mishra learnt that no permission for `NA' of the land had been obtained.
Thereafter, every time she approached the developers they kept on promising her that soon they would complete the formalities and hand over the piece of land to her. She complained that four years had passed and neither did she get her land nor her money back.
The court has ordered the developers to pay the dues within one month from the date of the order.
ACCIDENT COMPENSATION AFTER NINE YEARS: A compensation of Rs 1,49,800 will be given to the wife and five children of an accident victim who died in a road accident on the East-West Solapur Highway nine years ago.
Additional member, Motor Accident Claims Tribunal (MACT), Pune, A S Rane, has ordered Jasbersingh Dhevanmal Vasan and New India Assurance Co Ltd to pay Rs 74,900, and the Maharashtra State Road Transport Corporation to pay Rs 74,900 to Zakeer Mohammad Ali Baig's kin, with interestat the rate of 12 per cent from the date of application.
According to the application, the deceased was a driver, residing at Hyderabad. He left Hyderabad in an Ambassador. A goods truck owned by Vasan was trying to go past a ST bus parked on the road. The goods truck dashed the Ambassador and it was sandwiched between it and the ST bus. Baig died on the spot. It was further contended that the ST bus was halted on the road hazardously. Thereby the ST bus was also partly responsible for causing the accident.
