Kokani escape: cops' bail plea rejected

MUMBAI, July 9: Additional Sessions Judge R Y Ganoo today rejected the bail applications of the police officials who were escorting dreaded gangster Feroz Kokani when the latter escaped from J J on May 6, 1998.

PSI Satish Laxman Gavate and head constable Suryaji Samant of the Thane police were arrested by the JJ Marg police on May 7, 1998. Opposing the bail application special public prosecutor (SPP) A G Deshmukh said that on May 6, the escort party comprising of PSI Gavate and six constables had brought Kokani and another gangster Salim Beg from Thane jail to the J J Hospital for treatment. Stating that both the policemen were involved in the conspiracy, Deshmukh said that before the incident, Kokani was seen talking to his brother and absconding accused Anwar and another accused near the police van. He further said that according to a statement given by a witness Kokani's father Abdulla Sarguru was overheard telling another accused at Mazgoan court earlier on the same day that all arrangements weremade.

Deshmukh revealed Gavate overheard Kokani's conversation with Anwar and later made changes in the escort of the two gangsters. Also, only one carbine-wielding constable was escorting Kokani after one was withdrawn. The SPP said the officer who was with Kokani earlier left the place and Kokani was taken to the urinals with his handcufffs removed.

Meanwhile, two persons came on a motorcyle and escaped with Kokani after opening fire on head constable Kardile, who later succumbed. Deshmukh said since the investigations are in progress and most of the accused are still to be arrested it would not be correct to release the policemen on bail.P S Sawant and S L Deshpande appeared on behalf of the policemen.
