NEW DELHI, July 17: The Delhi High Court today rejected Bahujan Samaj Party (BSP) leader Mayawati's plea for quashing of a First Information Report (FIR) registered by the Central Bureau of Investigation (CBI) for her alleged role in bunglings in the purchase of fire fighting floating pumps worth over Rs 4 crore during her tenure as Chief Minister of Uttar Pradesh.A Division Bench comprising Justices Devinder Gupta and N G Nandi also slapped a cost of Rs 10,000 on Mayawati for coming to court on ``baseless grounds'' and vacated an interim order granting her anticipatory bail.``We do not find any ground having been made out to quash the FIR. The petition accordingly is dismissed with costs quantified at Rs 10,000. The interim order stands vacated,'' the Bench observed in its 42-page order.
During the pendency of the petition, the Court in its interim order had said Mayawati in the event of her arrest in this case, would be released on a personal bond of Rs 5,000 and surety in the like amount.
Vacatingthe interim order, the Court said anticipatory bail granted to Mayawati ``will remain in force for ten days to enable the petitioner to obtain appropriate orders from a competent court of law.''
CBI registered an FIR in the special court at Lucknow on March 18, accusing Mayawati and nine others of committing offences under Section 120 B (conspiracy), 420 (cheating) of the Indian Penal Code and various sections of the Prevention of Corruption Act for their alleged role in the deal.
The investigating agency had alleged that Mayawati purchased the floating pumps at an exorbitant price illegally and had placed the order with M/s Fire Challenger at Chennai, whose proprietor was the president of Tamil Nadu unit of Bahujan Samaj Party (BSP).
