Court declines to rule on status of MPs

NEW DELHI, July 28: A Delhi court today declined to give its ruling on a plea seeking direction to the Central Bureau of Investigation (CBI) to clarify its stand on the status of nine MPs accused of taking bribes in the JMM bribery case saying the matter was ``premature''.

Disposing of an application by former Union minister Satish Sharma, an accused in the case, special judge Ajit Bharihoke said the three-judge bench of the Supreme Court was yet to give its final verdict on the special leave petitions pending before it.

Sharma in his application moved through counsel H R Bhardwaj, a former Union minister, said the CBI should be directed to comply with the Constitution bench judgement which granted immunity to the nine MPs under Parliamentary privilege and specify charges against him.

``Keeping in view the submission of prosecution (CBI) that they intend to file a review petition against the Constitution bench judgement and sought a longer date'', he said the ``matter is disposed of aspremature''.

While fixing the next hearing for three days from August 24 to 26, Bharihoke said the trial should proceed subject to the apex court decision.

The nine MPs granted immunity from prosecution are Suraj Mandal, Shibu Soren, Simon Marandi, Ram Lakhan Singh Yadav, Roshan Lal, Anadi Charan Das, Ram Sharan Yadav, Abhey Pratap Singh and Hazi Gulam Mohammed. Bharihoke said the issues raised by Sharma had already been argued during earlier hearings after the apex court verdict and the pleas were disposed of in the similar circumstances.

He had argued that the CBI should confine itself to the charges mentioned in the chargesheet and not go beyond. According to the CBI chargesheet, Sharma had met former Haryana chief minister Bhajan Lal and some of the former MPs prior to voting on a no-confidence motion against the P V Narasimha Rao government on July 28, 1993 to ensure their support against the motion.

Besides Rao, Sharma, Bhajan Lal and the nine MPs, the other accused are former Union ministersButa Singh and Ajit Singh, former Karnataka chief minister Veerappa Moily and his two former colleagues Ramalinga Reddy and H M Revenna, Rajya Sabha MP V Rajeshwar Rao and two Bangalore-based liquor barons D Adikesavulu and M Thime Gowda.
