CHANDIGARH, Aug 14: Allowing a special leave petition of Government Medical College (GMC), Chandigarh, regarding reservation in "single-cadre" professors' posts, the Supreme Court today set aside the judgment of the Delhi bench of the Central Administrative Tribunal directing such reservations in the College.A division bench of the apex court, comprising Justice S P Bharucha and Justice V N Khare, held that since a constitutional bench of the apex court had already ruled that reservations cannot be extended to single-cadre posts, the tribunal judgment does not hold, reports reaching here from Delhi said.
Vacating the stay on the selection list of the Union Public Service Commission (UPSC), the Supreme Court also directed it to declare the results of interviews held earlier for the posts of professors in the college. Earlier, while appearing for GMC, the Additional Solicitor General of India, Altaf Ahmed, had informed the court that the UPSC had already completed the selection.
The same bench of the apex court today also adjourned to December 14 the SLP regarding recognition of Government Medical College, Chandigarh, by the Medical Council of India.
The Government Medical College (GMC), in its SLP, had contended that the posts of professors in different departments by virtue of their duties and qualifications was different and thus should not be clubbed for the sake of reservation, as with this criterion, such posts would be designated as a single-cadre post.
The GMC had filed the SLP against the order of the CAT which was granted in favour of the SC/ST Medical Association, Delhi.
With today's Supreme Court judgment on reservations in single-cadre posts, the posts of eight professors on deputation in the Sector 32 GMC would be filled up through direct recruitments, after the UPSC declares the results of interviews held by it between August and December last year. The UPSC had conducted interviews for filling up 10 posts of professors, but the results were witheld due to the CAT order.
As many as 11 professors were functioning on deputation with GMC till now and interviews for the posts of professors in the departments of surgery, psychiatry and ENT are yet to be held.
The recognition of Government Medical College by the Medical Council of India is directly related to the appointment of regular staff. Meanwhile, the provisional recognition granted to GMC by the Ministry of Health and Family Welfare till August next year would continue.
