CHANDIGARH, Aug 16: A colour TV company has been directed by the UT Consumer Disputes Redressal Commission to either replace the TV set of a consumer or refund money along with 12 per cent interest on account of a defective TV set.T D Verma, a resident of Nalagarh, Himachal Pradesh, purchased a colour TV from an authorised dealer of Uptron India Limited, Sector 34. However, the TV developed a defect and the picture disappeared within half an hour of its running. Two service engineers deputed by the company could not rectify the fault. Besides, the consumer also had to pay charges to the engineers.
The TV set had to be brought to the City from Nalagarh where it was found that the picture tube of the television had become unserviceable and had to be replaced at a cost of Rs 8,000. The complainant claimed that the TV set had developed a fault within the warranty period and he was not liable to pay for the picture tube.
The district forum directed that the complainant was entitled to Rs 550, besides replacement of the old television with a new defect-freetelevision of the same kind. The UT Consumer Disputes Redressal Commission comprising president J B Garg and member P Ojha observed that since the defect developed within the warranty period, the consumer was entitled to replacement of the TV set or its price together with interest at the rate of 12 per cent per annum.
