MUMBAI, Sept 7: The Bombay High Court today struck down an admission rule for Ayurved, Homeopathy and Yunani medicine courses which compelled aspiring students to pass the qualifying exam (HSC) in the first attempt securing minimum 50 per cent marks in the Science subjects.The division bench of Justices Ashok Agarwal and S S Nijjar allowed a petition filed by C Y Gujarati. They said the rule was unjust and unjustifiable. The petitioner had secured 44.50 per cent marks in Physics, Chemistry and Biology. He was aspiring to get admission in the National Homeopathic College at Nasik.
The court ruled that when available seats in medical colleges are more than the number of applicants, the government should not impose stringent standards for admission. The rule is justified only when the students applying for the courses are much more than the available seats.
