CM kin's building: HC orders panchnama

MUMBAI, Sept 8: The Bombay High Court today ordered Pune's District Court to establish through a panchnama whether Girish Vyas, son-in-law of Chief Minister Manohar Joshi, had flouted the stay on construction at the site of a residential-cum-shopping complex he is building off the Prabhat Road in city's elite Erandwane area.

The stay was ordered by the division bench of Chief Justice M B Shah and Justice Y S Jahagirdar a fortnight back while hearing two petitions - one filed by a journalist Vijay Kumbhar, and the other by Congress corporator Nitin Jagtap - alleging that the complex was being built on a piece of land reserved for a primary school.

The HC has asked the district court to appoint an officer to conduct the panchnama and has also specified a date and time - September 12 at 11.30 am - for it. The panchnama report will have to be submitted to the HC on September 14. Also, Vyas has been told to deposit Rs 3,000 with the Pune District Court to meet the expenses of the panchnama.

The High Court,however, today allowed Vyas to carry out internal works mentioned in a letter issued by his architect. These include internal plastering, painting, tiling, electrification, fixing of doors and flooring.

Earlier, Advocate Bobde, who represents one of the petitioners, produced a set of ten photographs to substantiate his charges. However, Vyas' lawyer Adv. Satyaranjan Dharmadhikari argued that since the construction work in the building was complete, there was no question on flouting the stay order.

In his support he produced a set of photographs and some certificates issued by an architect. He also questioned the need to raise the issue now when the Pune Municipal Corporation had already been ordered to withhold the completion certificate to the building.

Meanwhile, Chief Minister Manohar Joshi, Pune Municipal Corporation and Vyas Construction Company who have been ordered by the court to file their affidavits failed to do so.
