PUNE, Sept 9: Terrorist and Disruptive Activities (Prevention) Act designated court judge S R Dongaonkar has rejected the bail application of legislator Pappu Kalani in the Maruti Jadhav murder case in a 50-page judgement delivered recently.Jadhav, a member of the Gopal Rajwani gang, political rivals of Pappu Kalani, was shot dead in his office by three co-accused of Kalani. A witness was injured during the incident.
The prosecution submitted that Kalani, who has been in the Yerawada jail for the past six years, is a hardcore terrorist with six cases pending against him, falls in category A and cannot be granted bail. Though this submission was rejected by the court, bail was not granted to Kalani.
Kalani's counsel argued that though he has been assigned the role of a conspirator, the prosecution did not claim that he was present at the scene of the crime or had used any weapons. The counsel maintained that the case fell in category C, namely conspirators and abettors, and so bail can be granted. He said Kalani was released on bail in two bombing cases earlier by a TADA court and the order was confirmed by the Supreme Court.
