2-week judicial remand for SE

CHANDIGARH, Sept 25: Superintending engineer K.B. Sharma was remanded to judicial custody for 14 days by UT Judicial Magistrate (Ist Class) Jasbir Singh in the Engineering Department kickbacks case, after he surrendered before the court in the afternoon today.

His plea for anticipatory bail, filed against the orders of arrest warrants, was dismissed by the Supreme Court on September 23.

Today, soon after Sharma was remanded, the assistant district attorney -- in-charge of the case -- objected to the magistrate's orders. The ADA said the magistrate should have heard the prosecution before passing the order. He added that the notice regarding Sharma's surrender was not given to the Vigilance Cell.

An application seeking production warrants of the accused for tomorrow and advancing the next date of hearing was also moved by the ADA. Taking up the application, the magistrate issued notice to the defence counsel for tomorrow.

Sharma was booked by the UT Vigilance Department under the Prevention of Corruption Act on the allegations of receiving kickbacks for issuing supply orders. According to the prosecution, there were several entries against his name in the diaries of the alleged middlemen, recovered during raids at their residences by the income-tax authorities in November last year.

During the proceedings, the warrants of arrest issued against him were recalled twice by the magistrate on July 18 and on August 8. Seeking the recalling of the warrants issued on June 13, the defence counsel said that Sharma was not absconding and had re-joined duty.

The warrants were, however, re-issued on August 1 following the dismissal of his anticipatory bail by the Punjab and Haryana High Court, but had to be recalled again after his arrest was stayed by the apex court.

Meanwhile, the magistrate, taking up another application for providing "B" class facilities to the accused, directed the superintendent of Model Jail in Burail to provide the same in accordance with the provisions of the jail manual. He also directed examination of Sharma at the Sector 16 General Hospital on another application moved by the defence.
