Oct 6 fixed for Dhillon's bail plea

CHANDIGARH, Sept 25: Human rights activist Jaspal Singh Dhillon's bail plea will come up before UT Additional District and Sessions Judge G.S. Sandhu on October 6.

He was earlier booked by the Chandigarh Police under Sections 419, 420, 468, 225-B and 120-B of the Indian Penal Code, besides Section 4, 5, 6, of the Explosives Substances Act in the jail break conspiracy case.

According to the prosecution, he was involved in a conspiracy to smuggle explosives into the jail premises for enabling "hard-core terrorist" Jagtar Singh Hawara and other alleged assassins of the former Punjab chief minister Beant Singh to escape.

Seeking his release on bail, the defence counsel contended that the police have failed to collect evidence to connect the accused with the offences under which he has been booked.

He added that Section 419 and 420 of the IPC were not made out against the accused as he was not concerned with the alleged meeting of the co-accused in the case with the jail inmates.

Regarding the allegations of forging the documents, the counsel stated that Dhillon had not been accused of forging or using forged documents for cheating.

Claiming the absence of evidence regarding criminal conspiracy, he added that the accused was not involved in the procurement, possession or recovery of the explosives.

He further added that in the absence of attempt to blow up the jail, Dhillon could not be accused of committing any offence.

Opposing the bail plea, the prosecution, in its written reply, stated that the accused had played a role in the conspiracy by supplying money for the commissioning of certain offences.
