NEW DELHI, September 25: The Delhi High Court has decided to defer till October 6 its decision on the deportation of the AIDS-afflicted Ugandan national currently detained in Tihar on charge of drug smuggling.The Ugandan High Commission today failed to state its stand on the surety demanded by the High Court that the accused, Dorothy Mamirim, would be sent back to India to face trial if she survived the disease. The court had yesterday agreed to allow her deportation provided the High Commission gave the surety.
Justices Y K Sabharwal and K.S. Gupta deferred the hearing after being informed that the Ugandan government had not intimated its decision on the high court direction that ``certain high officials of the Ugandan High Commission here should stand surety as a pre-condition for the accused's deportation''.
The petition was filed by the Aids Awareness Groups (AAG) on behalf of the accused praying that the she be deported to her native country so that she could spend her last few days with her relatives and friends. The counsel for petitioner was directed to take up the matter with the high commission and intimate about the outcome today.
