Court allows standard VII student to attend school

NEW DELHI, September 27: Kamal Deep, a standard VII student, can attend school again. His admission had been cancelled on September 2 by the principal of Kendriya Vidyalaya Sangathan (KVS), Jawaharlal Nehru University campus, for allegedly producing a fake transfer certificate in 1995. Civil Judge Alok Aggarwal said in his order that neither had the school authorites conducted an inquiry nor had the boy and his father been given an opportunity to be heard.While saying that prima facie (on first impression), Deep had a strong case the judge observed that unless it was proved that the boy's father had used fraudulent means to secure admission the boy could not be deprived of his right to education. The KVS authorities have been directed to let Deep attend classes as an interim measure until the final disposal of the case. The matter will next come up for hearing on December 14. The school authorities cancelled Deep's admission alleging that his father had submitted a fake transfer certificate at the time of his son's admission to standard IV in 1995. A petition was filed on behalf of Deep through counsel S.K. Saxena. Meanwhile, counsel for KVS said there was a register that had an entry which said the admission was made on the basis of a transfer certificate.
