Notice to police chief in abduction, rape case

NEW DELHI, November 4: The Delhi High Court has issued a show-cause notice to Delhi Police Commissioner V.N. Singh on a plea seeking transfer of the case of a minor girl, who was allegedly abducted, raped and sold to brothels in connivance with police personnel, to the Central Bureau of Investigation.

Justice Anil Dev Singh has also directed SHO of the Inderpuri police station M.S. Malik to produce all records and the investigation report concerning the case within a fortnight. The SHO has also been asked to be personally present in court on November 10, the next date of hearing.

The petition, filed by the girl's father Ramesh Kumar Shihan through his counsel Asit Kumar Roy, states that 11 persons, allegedly in nexus with police personnel, abducted the minor, kept her in illegal confinement, raped her and sold her to brothels in Patna to earn money. The 17-year-old girl was rescued from Barh village of Patna district in September. Shihan claims that the 11 persons, who have been named in the petition, were engaged in the lifting of minor girls from in and around Delhi and selling them to brothels from where they were illegally transported outside the country.

The petition also alleges that the Inderpuri SHO, a sub-inspector and three head constables had given a helping hand to the culprits in their illegal business under the control of an underworld gang operating in Delhi. The petition contends that a number of girls have been lifted from Inderpuri village itself within the past six months.

Alleging that an FIR was lodged only against one of the accused by twisting facts, Roy urged the court to direct the police to register FIRs against all the 11 accused and hold a departmental inquiry against the police personnel, including the SHO, after suspending them.

The petition states that though incidents of abduction of girls were taking place, the local police were silent spectators and did not even bother to look into complaints lodged by the sufferers at the hands of the gangs.

The present case, the petition adds, is one such example of glaring illegal acts of omission and dereliction of duty on the part of police personnel, who, instead of helping the petitioner, acted hand in glove with the criminals and culprits.

On August 28, when the girl was going to her school, three persons allegedly pulled her into the autorickshaw they were travelling in, gagged her and made her unconscious.

When the girl came to, she reportedly found herself on a train to Patna along with three persons, including a woman. In Patna, she was taken to some unknown place and was allegedly raped repeatedly by her abductors. After being confined for a few days, she was reportedly sold to a brothel keeper `Machhiliwali' for Rs 20,000.

When the girl did not return home till August 28, the villagers started investigating the matter and found that some local persons were involved in the abduction of girls who were later sold to brothels outside Delhi.

After catching hold of nine of the accused, the village panchayat issued a panchanama, in which they confessed to kidnapping the girl and taking her to Patna to sell her to a brothel, and took their thumb impression on it. The document was then handed over to the police for appropriate action. The petition also states that the local police showed reluctance in registering a case against the accused.
