MUMBAI, November 11: The Bombay High Court today stated that it cannot give permission to the state government to denotify the forest land in the Sanjay Gandhi (Borivli) National Park adding that it is the government's responsibility to relocate the 33,000 slum households who are eligible for an alternate site.The division bench of Chief Justice M B Shah and Justice S Radhakrishnan granted granted one week's time to Bombay Environmental Action Group (BEAG) to file a rejoinder to the state government's affidavit. During the last hearing, Conservator of Forests, Borivli, Suresh Gairola, had filed an affidavit claiming that the government was unable to relocate the slumdwellers due to unavailability of land and sought the court's permission to denotify the slums area. The Chief Secretary today filed another affidavit reiterating the government's position.
To this CJ said the government cannot discriminate against these slumdwellers. Government pleader R V Govilkar argued that the relocation of other slumsis not difficult because the households have to be given houses on the same plot, whereas the 33,000 slums are to be given new land.
