NEW DELHI, Nov 13: Former Bihar chief ministers Laloo Prasad Yadav and Jagannath Mishra today filed special leave petitions (SLP) in the Supreme Court seeking bail in the Rs 950 crore fodder scam conspiracy cases while challenging the Patna High Court order rejecting their bail plea.
A three-judge Bench comprising Chief Justice A S Anand, justices V N Khare and M Srinivasan fixed November 20 for hearing of the SLP filed by Mishra after the same was mentioned before it by counsel A M Khanwilkar.
Counsel for Yadav, B B Singh, mentioned that the Rashtriya Janata Dal president has also filed an SLP today and the same may be tagged along with Mishra's petition for hearing on November 20. The Bench advised the counsel to bring the same to the notice of the registry for necessary action.
Mishra, in his SLP, said he was granted bail by the Supreme Court in a fodder scam conspiracy angle case on October 13, 1997. He alleged that CBI had arrested him again in another conspiracy case where the charges and thematerial relied against him were same as the previous case.
Yadav in his SLP termed the CBI action of arresting him again as politically motivated while Mishra has pleaded for grant of bail on medical grounds as well.
The 61-year old Mishra submitted that he had already undergone angioplasty at Apollo Hospital, Chennai and the doctors had warned him that if the angioplasty develops a snag he might have to undergo bypass surgery.
The Patna High Court on November 10 had rejected the bail plea of Yadav and Mishra, former ministers Vidya Sagar Nishad and C P Verma and controversial RJD MLA R K Rana in a conspiracy angle case of the fodder scam.
The High Court in its order had said in view of the gravity of charges and documentary evidence, prima facie involvement of the accused was made out in the conspiracy that resulted in irregular withdrawals from the treasury by the state Animal Husbandry Department.
However, the court did not pass any order on CBI's application challenging lodging of Yadav andMishra, who is the chief patron of Bihar Jan Congress, in judicial custody at the make-shift jail at the BMP guest house.
The five accused had moved the High Court against the October 30 order of the designated CBI judge S K Lal rejecting their applications for bail. Lal has remanded them to judicial custody in the case till November 13.
