Fresh summons to Sec 11 SHO, ASI in assault case

CHANDIGARH, Nov 25: The Station House Officer of Sector 11 Police Station Inspector Vijay Kumar, besides Assistant Sub Inspector Ashwani Kumar, were issued summons again by UT Judicial Magistrate (Ist Class) Jag Nahar Singh for February 1, 1999 in an assault and wrongful confinement case. Sub Inspector Charanjit Singh was, meanwhile, granted bail.

They trio had earlier been summoned by the court on a cable operator, Maninder Singh's complaint. He had alleged that he had been assaulted, tortured and illegally detained by the accused, at the behest of rival cable operators, after being called to the Police Station on May 25. He had further alleged that SI Charanjit Singh was also directed to implicate him in an attempt to suicide case by the SHO.

Claiming to have been threatened with dire consequences for laying a cable in his rival's territory, the counsel for the complainant had further alleged that the SI had also slapped and abused him. The complainant was running operations in Sector 21, 22, 18, 17, 35, 41, 42, 43, 43, 45 and Sector 15, he had added.

Maninder fell unconscious after he was taken to another room and bashed up by the SI, along with the ASI and few other officials, the counsel had further alleged. He was also taken to the General Hospital for medical examination, the counsel had added.

The magistrate, after examining the witnesses, had observed: "It is prima facie clear that the accused have committed offences. Therefore, there are sufficient grounds to proceed against them under Sections 330, 323, 348, 352, 357 read with Section 34 of the IPC".

The process had to be issued again today as the ASI was on leave, while the summons issued against the SHO could not be served properly. SI Charanjit Singh was, meanwhile, directed to be released on bail after furnishing bonds of Rs 5,000 along with a surety of a like amount.
