Shop owner told to compensate for selling substandard cement

CHANDIGARH, Jan 20: UT Consumer Disputes Redressal Forum has directed the proprietor of Prem Hardware Store, Chandigarh to pay Rs 1,040 as compensation for supplying substandard super-cem to a customer. The Forum has further directed the said party to pay Rs 1,100 as costs for supplying defective goods to the customer.

The complainant, Nagar Singh Toor, a Mohali resident, had earlier stated that he had purchased five packets of super-cem from the opposite party in December 1993. The same cement was used in construction of the house but quality of the cement was so poor that it soon turned into powder and started wearing down causing pollution in the house, apart from damaging paint and polish of the walls.

The complainant added that his health was adversely affected due to the poor quality of the material supplied.

Stating that he was not adequately compensated by the opposite party, he filed the complaint asking for a compensation of Rs 11,935 and another Rs 10,000 for causing ailment to him.

The Forum bench comprising president R.P. Bajaj and members H.S. Walia and Kamlesh Gupta, in their decision, held that the cement supplied to the consumer was of a poor quality and the same was confirmed by the engineer's report.

In view of the deficiency in services, the Forum bench directed the shop ownwer to pay the said compensation to Nagar Singh Toor.
