Anticipatory bail for deputy E&T commissioner

CHANDIGARH, Jan 27: On an application seeking anticipatory bail for Deputy Excise and Taxation Commissioner Mukesh Gambhir, the Punjab and Haryana High Court today directed that the petitioner would be enlarged on bail by the investigating officer in the event of his arrest.

Pronouncing the orders in the open court, Justice R.L. Anand also directed the petitioner against leaving the country without the Chief Judicial Magistrate's prior permission.

Justice Anand further directed Gambhir to surrender his passport, if any, to the investigating officer, not to tamper with the evidence and to join the investigations as and when asked to.

Gambhir was booked by the Haryana Police under the Prevention of Corruption Act on November 26 last year after a raid was conducted at his residence by the vigilance authorities.

Explaining the acquisition of assets allegedly recovered from his residence, Gambhir had stated that the same were acquired from the income of his wife Dr. Renu Gambhir. Being a class I officer, she was earning ``good income,'' he had added. Further, a ``lot of property,'' including gold and cash, had been inherited from his mother, he had stated.

Claiming to have explained ``each and every article in the house'' to the investigating agency's satisfaction, the petitioner had also stated that he had been joining the investigations of the case from time to time.

Expressing apprehension regarding the application of third degree torture method by the police if custodial interrogation was permitted, his counsel added that respondents were ``after his blood'' as the high court had ordered an inquiry against their conduct while raiding his residence.
