NEW DELHI, January 29: Metropolitan Magistrate K.S. Mohi today allowed the crime branch to go ahead and record Romesh Sharma's voice. The police are trying to match this with a recording they have of a person, alleged to be Sharma, in conversation with Dawood henchmen in Pakistan and the United Arab Emirates.The order was passed following a crime branch appeal which said a voice sample was required for further investigation in the case. The crime branch tapped Sharma's cellphone after they received information that he was frequently in touch with Dawood men. In a related development, Sharma got statutory bail in the Babloo Srivastava case, when the crime branch failed to file a chargesheet within the stipulated 90 days. The accused is alleged to have masterminded a plan to get gangster Srivastava -- now in Naini jail, Allahabad -- killed.
In another case, Metropolitan Magistrate J.P. Narain objected to the filing of a chargesheet against Sharma in his absence. The challan was filed on January 26, a court holiday. This is the case in which Sharma is accused of ``forcibly'' taking lawyer Rajiv Gupta's Piaget watch. Sharma, who was arrested by the south Delhi police on October 20 last year, faces charges in 17 cases. Case no: 17 concerns charges brought against him by a Mumbai-based businessman Dinky Mascaranhas. The businessman has alleged that Sharma ``grabbed'' two of his imported cars and a cellular phone. Sharma also allegedly extorted Rs 5 lakh from him. The case was registered at the Hauz Khas Police Station.
``Sharma has not yet been produced in any court in connection with the Mascaranhas case,'' said Sharma's counsel Ramesh Gupta.
He has been granted bail in five cases. He was also given bail in the passport case, which is a non-bailable offence. His defence had argued that the CBI failed to file a chargesheet within the stipulated time period. He has also been granted bail in the Wildlife, Excise and Arms Act cases the latter two are bailable offences.
Sharma's counsel has moved three applications for bail, which are pending in various courts. One of them concerns the ``grabbing'' of the C-30, Mayfair Garden house, a case in which he is up for statutory bail. Seven of the 17 cases are being handled by the Hauz Khas Police Station, while two are being investigated by the Central Bureau of Investigation (CBI) and four investigations are being handled by the Crime Branch.
The CBI is looking into the complaint filed by a director in Pushpak Aviation, Suresh Rao who had alleged that Sharma had ``grabbed'' his helicopter. The agency is also investigating the passport case -- Sharma had reportedly got a passport made for Dawood Ibrahim's mother Amina Bi after the 1993 Mumbai riots.
