CHANDIGARH, March 1: UT Chief Judicial Magistrate Sant Prakash today issued notice to UT Estate Officer on a petition filed here today seeking to restrain him from interfering in the peaceful running of the shop of the plaintiff.In a suit filed today, Kishori Lal, the plaintiff, stated that he is running an STD/PCO shop in a 15-square metre area of his house and that no other part of the house was being used for business purpose.
It was stated that the Government of India and UT Administration had issued a gazetted notification on June 19, 1998, by which all transferees are allowed to use up to 20 per cent of the residential area of the building, subject to a maximum of 15 square metre for installation of STD/PCO/Fax or photostat machine.
It was submitted that as per the said notification, the defendant had no right to interfere in the peaceful running of his business.
It was added that the plaintiff was litigating the defendant against resumption of his building and the case was still pending.
, and also that the said resumption was liable to be set aside in view of the notification issued earlier.
The plaintiff added that officials of the defendant were threatening him to stop running his business activity and that his business was being adversely affected in the wake of frequent visits of these officers to his premises.
