Lawyer in custody for in contempt of court

AURANGABAD, March 12: A practising lawyer at the Aurangabad bench of the Bombay High Court here has been remanded to a week's judicial custody for committing contempt of court on two consecutive occasions while arguing a revision petition on Thursday.

The petition, filed by his wife Anjali, challenges recovery proceedings initiated against her for a loan secured from the Vaidyanath Cooperative Bank in Beed district. The Rs 7.2-lakh loan, taken to start a hotel, now stands at Rs 30 lakh.

Arguing on behalf of his wife, the petitioner Tatyarao Chikhale had alleged among other things that the recovery drive against his wife had been initiated at the behest of Deputy Chief Minister Gopinath Munde, who hails from Beed district.

While arguing the revision petition before Justice B H Marlapalley, Chikhale had levelled serious charges of a personal nature against the judge and his family. Since the lawyer had mentioned his permanent address in the petition as Beed district, the judge had asked the superintendentof police, Beed, to issue a non-bailable arrest warrant against the lawyer and a bailable arrest warrant against his wife.

While this warrant was still in the process, a second hearing in the case witnessed another outburst from Chikhale, who invited contempt of court proceedings yet again. This was served under Section 215 of the Constitution and Section 14 of the Contempt of Court Proceedings Act.

The lawyer has also filed a bail application before Justice V V Barde and Justice J A Patil, and sought two week's time to arrange for a suitable lawyer to defend his case. State Advocate General C J Sawant is representing the state in the contempt cases.
