Summons against Mamta Kulkarni

MUMBAI, March 19: Additional Chief Metropolitan Magistrate K H Holambe-Patil today issued summons to actress Mamta Kulkarni and photographer Jayesh Sheth in connection with photographs of the actress published in a film magazine in 1993. The actress and photographer have been directed to appear before the court on April 21, 1999.

A criminal complaint was filed in 1993 by the vigilance branch of the Mumbai police against Magna Publications and Ashwin Varde, the then editor of film magazine Stardust, following the publication of obscene photographs of the actress (taken by Jayesh Sheth) in the September and November 1993 issues of the magazine.

The recording of evidence in the case began today. After the examination of the first witness, police constable Krishnadev Dyandev Patil concluded and cross-examination by the advocates for Varde (Ashok P Shahani and T Sridhar) was about to begin, assistant public prosecutor T T Shelke made an application before court that since Kulkarni and Sheth hadcommitted the same offence as Varde, process should be issued under Section 292 (sale of obscene books), 293 (sale of obscene objects to young persons below the age of 20) and 34 of the Indian Penal Code. The magistrate said he was satisfied that the persons named by the public prosecutor had committed the same offence for which the accused (Varde) was facing charges.
