HC directs police to register dacoity case against cops

EXPRESS NEWS SERVICE
AHMEDNAGAR, March 28: The Aurangabad bench of the Bombay High Court has rejected Ahmednagar police's request to stay its earlier verdict directing the later to register an offence of dacoity against seven persons, including a senior police inspector and a sub-inspector. The district police had sought a four-week stay to register the offence.

Justice V K Barde and Justice J A Patil, earlier had directed the Ahmednagar district police to register an offence against police inspector Jaywant Watre, former Shrirampur police station in-charge, PSI Satish Nikam and others. The police authorities, however, have sought the Home department's go ahead to challenge the HC decision which came on a petition filed by Yashwant R Kale, a Shrirampur resident.

Kale has accused Watre and others of having framed him in a case of illicit liquor and stealing gold and silver ornaments and cash worth Rs 60,000 under the garb of conducting a raid at his house. According to the police, an illicit brewery run by Kale was raided onMarch 10, last year, and some liquor was seized.

Kale also had resorted to a hunger strike demanding that an offence of dacoity be registered against the police. He had charged the police of harassing him despite he abandoning his illicit liquor business and trying to lead a unstained life. Leader of Opposition in Legislative Assembly Madhukar Pichad and local Congress MLA Bhanudas Murkute had written to senior police officials "to give justice to Kale".

When the senior police officials reportedly refused to register the offence against the police personnel, Kale filed a petition before the Aurangabad bench of the Bombay HC. The HC directed the police to register the offence and turned down the plea to stay the order.

Senior police officials stated that they have decided to challenge the HC decision in the Apex court "to protect the moral of the force for which raids and seizures were the part of their duty".
