Dubash assailant's bail plea rejected

March 28: The Sessions court last week rejected the bail application of the main accused in the attempted robbery near Gateway of India last year.Sushant Sarkar and his three associates had barged into the flat of Nariman Dubash (65) in Pheroze Building, near Gateway of India. Nariman's maidservant Mary Borges (55) was gagged and tied up when she tried to stop them at the door at 6.15 am on September 9, 1998.

However, her screams alerted Nariman who put up a fight before being overcome and injured with a knife. The robbers forced Nariman into giving them the key of the cupboard with and robbed Rs 5,813.

In the melee, a friend of Borges, Khetan D'Souza who was in another room managed to sneak out and bolted the door from outside. She alerted the police who arrived immediately and arrested the robbers.

On March 24, 1999 Sarkar moved the Sessions court for bail. Opposing the bail plea Special Public Prosecutor A G Deshmukh told the court that the robbery was well planned since only Nariman and Marywould be at home so early in the day. He also held that since Sarkar was a resident of Burdwan district in West Bengal he could abscond at any time.

Additional Sessions Judge R Y Ganoo rejected the bail plea.
