School told to take back sacked teachers

NEW DELHI, March 28: The Director of Education, S.C. Poddar has directed the management of the Delhi Jain Public School to reinstate the services of teachers who had been terminated and also asked it to revoke the suspension of another teacher.

He has also directed the school to fill the post of Post-Graduate Teachers and Trained Graduate Teachers; issue appointment letters to all employees in the presence of the education officer; and give teaching allowances to all the teachers, besides the due bonus for the year 1996-'97.

These directions were issued in response to complaints by teachers and the Parent-Teachers Associations of the school.

They had complained about illegal suspension, termination of services of teachers and the non-payment of salary according to recommendations of the Fifth Pay Commission.

Reportedly, the teachers of the school have been on a dharna outside the office of the Director of Education.

Acting on the complaint, a panel of officers of the Directorate of Education had carried out a special inspection of the school on March 8. The team pointed out that the services of certain school teachers had been terminated arbitrarily without the approval of the Director of Education. And the employees are not being given the facilities of bonus, LTC, Maternity leave, medical leave.

It was also pointed out that as per the enrollment of students, the school should have 12 PGT and 20 TGTs, while at present the school had only one PGT and 16 TGTs. In his order, the director dismissed the representation of the school which said that the institution be considered as a minority institution saying that ``The contention of the Management for rights and privileges as a minority institution is not valid as Jain is not included as a minority community in the Government of India, Ministry of Welfare notification dated October 22, 1993, notifying the communities as the minority communities.''

He ordered that the compliance report as stipulated in the order must reach him must reach him within 10 days of the order, failing which appropriate action will be taken against the managing committee of the school, under Section 24 (4) of the Delhi School Education Act, 1973.

Meanwhile, Pankaj Jain, the director of the Delhi Jain Public School said that he had not yet seen the order. ``In case such an order has been passed, we'll protest against it in the court,'' he said.
