Dropsy case transferred to sessions court

NEW DELHI, April 9: While Chief Metropolitan Magistrate (CMM) R.K. Gauba today committed the dropsy case to a sessions court, Additional Sessions Judge (ASJ) K.S. Khurana granted bail to Dinesh Kumar Aggarwal and Vijay Kumar Aggarwal. Both had surrendered themselves to the CMM's court on March 15. The accused have been directed to pay Rs 50,000 each and one surety of the same amount. The accused persons have also been ordered to surrender their passports and will have to take prior permission before going abroad.

While committing the case to the sessions court, the CMM observed:``The case involves offences of culpable homicide not amounting to murder, which is triable exclusively by the court of sessions.'' The district and sessions judge will appoint the case to a court on April 16.

Forwarding the bail application, the defence counsels argued that since all the other five accused persons were out on bail, the court should grant Vijay and Dinesh bail too. They further submitted that the two persons had been lodged in Tihar Jail for a long time and keeping them in custody is no longer required since the investigation is over. ``Our clients did not have any role in the adulteration of the oil and the offence made out against them is false,'' the affidavit read.

The counsels also claimed that the final test report prepared did not mention anywhere that the oil traded by the Aggarwal mills was adulterated. ``The oil samples taken from the buyer, NDDB, does not say that they were adulterated with argemone.''

Vijay Aggarwal's counsel also told the sessions judge that his client did not trade in oil.
