In his application, the complainant pleaded that earlier he had filed a suit asking the court to restrain the defendant from interfering in the possession of canteen on the ground floor and also for restraining him from allowing anybody else than the plaintiff from selling eatables in the theatre premises.

The Civil Judge, after hearing arguments in the case, had granted interim injunction by ordering a status quo.

In his application, Garg stated that in spite of knowledge of the interim injunction, Ashok Kumar started interfering in the possession and threw the refrigerator outside the canteen. Four stabilisers were also forcibly removed, it was stated in the application. The plaintiff added that he reported the matter to the police.
