Black films on cars allowed subject to DGP's approval

CHANDIGARH, JULY 27: Hearing arguments on certain applications in the traffic regulation and pollution control case, the Punjab and Haryana High Court today clarified that "persons not provided with official cars but using private cars can use black films of requisite thickness and colour subject to the condition that the Director General of Police issues a certificate to the effect giving the vehicle number".

Pronouncing the direction in the open court, Justice Swatanter Kumar observed: "The clarification would no way liberalise or dilute any other direction issued in the judgment."

Justice Kumar also reserved orders on certain application including the plea by Shiromani Gurudwara Prabhandak Committee president Bibi Jagir Kaur seeking exemption for Sikh women from wearing helmets.

Regarding the implementation of the directions, Justice Kumar ordered: "All directions more particularly in relation to zebra crossings, marking on the roads, school buses, attendants in the buses, red lights, flags, hoarding, demarcation of no overtaking zones, in addition to all other directions which have not been stayed shall be enforced and implemented without delay".

Accepting the "common request of all the States and the UT Administration", Justice Kumar observed: "The Court is inclined to grant extension for the implementation of the various directions. The Chief Secretaries and the Director Generals of Police of the respective states and Advisor to the UT Administrator and the Chandigarh Inspector General have been directed to file a compliance report within one month as prayed by them."

Justice Kumar also observed: "The Administration had issued directions regarding driving with lights dipped. The enforcement would be appreciated but the department must ensure that street lights especially on the main roads are functional."

Justice Kumar also verbally directed the Municipal Corporation Chief Engineer to take samples from the bucket of the paint being brushed on the city roads and streets.

Earlier during the proceedings, the counsel for the states of Punjab and Haryana, besides the standing counsel for the UT Administration stated that some persons "otherwise entitled to use black films for security reasons in the wisdom of the state can not use the same as it was permitted only in official cars".

The High Court, in the order pronounced on July 9 last year, had made helmets compulsory for both men and women riders and those on the pillion. Persons wearing turbans had, however, been granted exemption.

The use of black films had also been banned. Exemption was provided only for security reasons. The High Court had also directed the introduction of one way traffic in Sector 24 and 17 and the commercial sectors in the city within 15 days. The court had further ordered the demolition of two shops constructed on the road in Sector 24 and the restoration of the road to the original as they were a hindrance to the free flow of traffic.
