Pronouncing the orders on candidate Upasana's plea, Justice V. S. Aggarwal of the High Court also held: "If no seat is available, an additional seat must be created to adjust the petitioner".

In her petition, Upasana had alleged that PU and other respondents had "deliberately and intentionally" withheld her result card to "mar her career".

The counsel for the petitioner had added that Upasana was "deprived of her right to take counselling and ultimately admission to the MBBS course".

The counsel had stated that the result card had been placed in the mail box on June 24. Upon receiving the card, she approached the authorities the next day, but they were not willing to accept the application, the counsel had further added.

The counsel had added that Upasana came to know about her clearing the exam through newspapers but was not able to fill in the form as the result card had not been issued to her.
