CHANDIGARH, Aug 26: The Food and Supplies Department, UT, here filed its reply in a public interest litigation filed by Jagrukta Weekly which sought the court to direct the defendants, including the Ministry of Petroleum, to control black marketing of LPG domestic cooking gas and also take necessary steps against those found black marketing cylinders for uses other than domestic.Among other defendants in the suit are the various oil corporations and the city SSP.
In the suit which is pending here in the court of UT Civil Judge (senior division) H.S. Madaan the plaintiff Jaspal Singh maintained that though the government is contributing Rs 85 as subsidy per domestic gas cylinder, the same is not being given on cylinders meant for commercial purposes. It has been added that gas agencies in the city alone are selling about 15,000 cylinders in a month and out of the total sale, about one-fourth cylinders are being sold in the black market. The plaintiff stated that the government is thus losing about Rs 1,11,56,250 per month as subsidy. The plaintiff further adds that the Food and Supplies Officer is the controlling authority in this regard and also the city's SSP is liable to check black marketing of cylinders by way of registering cases against those found guilty.
Stay application against panchayat dismissed
The court of Civil Judge (junior division) Mahender Singh has dismissed the stay application against gram panchayat , Maloya in a suit filed by one Daya Kishan of the same village who stated that a particular plot occupied by the panchayat actually belonged to him.
Observing that the said property instead belongs to the panchayat and it was set aside for the purpose of children's park, the court held that the panchayat would suffer an irreparable loss in case the application is allowed.
The applicant stated in his suit that he was the actual owner of the land. He also brought to the notice of the court a previous order of Additional Sessions Judge Ambala, Jagwant Singh, which he said had declared him the owner. The court, however, held that the said order pertained to some other property and not to the one in question. Accused gets one-yr RI in cheque bounce case UT Judicial Magistrate (Ist Class) Jasbir Singh has sentenced a Solan resident Harjinder Pal Singh to one year rigorous imprisonment in a cheque bounce case. The Magistrate further directed the accused to pay a fine of Rs 500. The order was passed on a complaint instituted against the accused by one Dev Raj Garg.
The fcomplainant had advanced a loan of Rs 50,000 to the accused for some business purpose. In discharge of a part of this liability the accused issued Rs 10,000 cheque to be drawn on Jogindra Central Cooperative Bank. The cheque, however, got dishonoured. The complainant later sent a notice to the accused through registered post and the same was served upon him duly but the amount was still not paid.
The Magistrate held the accused guilty and maintained that he did not consider his case fit for release on probation. The accused was sentenced to undergo imprisonment and pay fine. In case of default of payment of fine he was directed to undergo further RI of one month.
