NEW DELHI, JANUARY 17: Sacked trustees of the Indira Gandhi National Centre for Arts (IGNCA) on Monday contended before the Delhi High Court that the Government action ordering restructuring the trust was "illegal and arbitrary".Senior advocate Gopal Subramaniam in a rejoinder to the Government affidavit told Justice J B Goel that suspension of the trustees was prima facie "illegal and arbitrary" as neither the legal opinion sought by the Government nor an order passed by a division bench last year authorised it to nullify the amendment to the trust in 1995.
Subramaniam said any amendment to a trust deed could not be nullified by an executive order as only a competent court has power to adjudicate on the issue.
He also termed as "wrong" the government's contention that the trust was its creation and said any instrument of a trust was a subject matter of private law.
