‘CBI FIR in Rizwanur’s death is contempt’

Kolkata, March 12 The West Bengal government today urged the Calcutta High Court to be careful in future while directing the cases like that of unnatural death to the Central Bureau of Investigation and alleged that the investigative agency had violated the court’s order in the Rizwanur Rehman murder case.

Advocate-General Bolai Roy said the CBI had started the investigation by registering a murder case, which amounts to the violation of the court’s order since the latter had ordered for a probe into the “unnatural death” of Rehman rather than his “murder”.

How could the CBI lodge an FIR for murder even before conducting the case, Roy said and urged the court to reject the report since it was tantamount to a contempt of court.

He further said the agency could have conducted the investigation without registering an FIR. If at all an FIR was necessary the CBI could have come up before the bench for permission. Referring to the report, Justice Dipankar Dutta said the agency had collected information from the writ petition before registering the FIR.

Later, Roy told the media that he urged the court also to dismiss the writ petition.
